The mechanics

In a white-label arrangement, an agency sells a service to its client, then hires an external provider to perform the work. The provider delivers the work to the agency, branded as the agency's own, and has no contact with the end client. The agency sets the price, sends the invoice and owns the relationship.

What governs it

The arrangement is normally governed by a non-disclosure agreement that prevents the provider from identifying the client, contacting the client, or naming the engagement in its own marketing.

How does white-label work?

Is white-labelling ethical?

It is standard practice across almost every industry. Your client bought your judgement, your accountability and your relationship. Who performs the keystrokes is a supply-chain decision, exactly as it is when a law firm uses a paralegal or a builder uses a subcontractor.

Is white-labelling legal?

Yes, and it is normally formalised in an NDA. Check your own client contracts for any clause requiring disclosure of subcontractors. Some enterprise contracts have one.

What if my client asks directly whether we do the work in-house?

That is your call and your relationship. Most agencies say they have a team, which is true. We will never be the ones to answer that question.
